Established in 1941, the primary goal of the Defense Base Act was to ensure coverage of staff working on military bases outside the United States, regardless of nationality.
Since it origin, the Act has been amended to include public works contracts with the US government for the building of non-military projects such as dams, schools, harbors, and roads abroad. Further amendments have augmented the Act’s coverage. Today, almost all international labor contracts with U.S. government, whether military or civilian in nature, require Defense Base Act coverage.
Due to the rapid growth of such contracts, especially in Afghanistan and Iraq, it is more important than ever that companies be familiar with the Defense Base Act and comply with its mandate.
